Rainy and Inclement Weather

Exotic Car Rentals of New Jersey (We) do not offer refunds nor
cancellations for rentals when there is inclement weather. All
rental charges will apply regardless of weather and the Renter (You)
is obligated to pay for the rental in any case. However, we do have
two plans that apply in the event that Rainy Weather interferes with
your use of the rental vehicle during period May 1st through October
31st:
Option 1
- We offer a 10% discount on a future rental at no additional cost.
Example: At the time of reservation, you declined purchase our Rainy
Weather Policy and during the rental, it rained all day fairly
heavily. You notify us upon your return and we confirm that it had
been raining. We will issue to you a certificate for 10% off of the
next rental of a comparable vehicle for a comparable type of rental
(weekday or weekend day) and a comparable period of time.
Option 2
- You purchase our Rainy Weather Policy at 25% of the
total rental cost which provides a free future
rental. Example: At the time of the rental reservation (see
definitions below), you purchase our Rainy Weather Policy and pay
the 25% fee (25% of the total cost of the rental including taxes,
fees, etc.) for this policy. During the day of your rental, it
rained all day fairly heavily. You notify us upon your return and we
confirm that it had been raining. We will issue to you a certificate
for a free rental of a comparable vehicle for a
comparable type of rental (weekday or weekend day) and a comparable
period time.
Definitions and Important Facts
:
- Timing of
the purchase of Rainy Weather Policy – The purchase of the
Policy must be made with the reservation and must be at least 4 days in advance of the pickup of the rental vehicle
- Rainy
Weather does not apply in all cases:
- “Rainy
Weather” means rain of sufficient intensity and frequency
such that your use of the rental vehicle is actually and
materially interfered with (even though the conditions do
not physically prevent the vehicle from being operated)
Thus, a constant heavy rain throughout a rental day will
entitle you to use of the Discount. However, if it is only
cloudy, overcast or there is just an occasional light
drizzle, the Rainy Weather Policy would not apply as it
must be a continuous rainfall or several heavy downfalls –
you must notify us promptly on return of the date, time,
type of weather and location as we will need to verify this
with the weather service.
- You
rented for a three day weekend and it rained continuously on
just one day and notified us upon return, you would receive ONE (1)
free weekend day rental of the same car in
future, the policy does not apply to the other two days in
this case.
- There are
no provisions for refunds, cancellations nor discounts for other
Inclement Weather such as high wind, cold weather, etc. We will
consider on a case by case basis the issuance of a discount
for other severe weather conditions that in our opinion interferes with
the rental of your vehicle. The same provisions for notification
as in #2 above must be met for this to be considered.
- “Comparable
vehicle” means the same make and model of vehicle under the
current reservation or a make and model of vehicle identically
priced for rental as the one under the current reservation.
“Comparable period of time” means if your rental was for a
weekday, your free rental would apply to a weekday rental; if
your rental was for a weekend day (Friday, Saturday, Sunday or
holiday) and it rained, your free rental would apply to a weekend
day rental.
- If on
completion of the rental, you seek to claim entitlement to the
Rainy Weather Policy, you must immediately notify us so that we
are able to verify the conditions with the appropriate weather
service. Failure to so notify us will release us from any
obligations under the Rainy Day Policy.
- Within the
confine of the terms defined here, we will have the sole and
absolute and final discretion to determine whether the
conditions for Rainy Weather Free Day(s) have been met.
- Where we
have determined that the conditions for Rainy Weather Free Day()
have not been met, we nevertheless may determine that because of
the particular or combined weather circumstances, you will
receive a lesser discount for a future rental with us. We shall
have no responsibility nor obligation however to offer you such
a discount; where we do decide to do so, the extent and terms of
that discount remain within our sole and absolute and final
discretion.
- The Rainy
Weather Free Day(s) offered in this document must be redeemed and
used within one (1) year of the current reservation date and is
not transferable.
- No Rainy Day
Policy nor discounts are applicable for SUV rentals, this is
only for Sports Cars.
